These Terms
1.1 These are the terms and conditions on which I supply services to you.
1.2 Please read these terms carefully before you submit your booking to me. These terms tell you how I will provide services to you, and what to do if there is a problem and other important information.
2. RESPONSIBILITIES
2.1 I cannot be held responsible for chaperoning minors, nor guarding a house and household effects while tutoring. Please ensure that a responsible adult is on the premises at all times.
3. ILLNESS AND HOLIDAYS
3.1 The charge for the tutoring is £30 per hour. Please note that there can be considerable preparation involved before each session of tuition. If you need to cancel and rearrange a tutoring session, I ask that you provide me with at least 24 hours’ notice.
3.2 In the event you are unable to provide at least 24 hours’ notice, I may, at my discretion, charge you the standard tutoring session fee, as applicable at that time.
3.3 If you have prepaid for a block booking and you do not provide at least 24 hours’ notice, I may at my discretion, deduct that tutoring session from your remaining tutoring sessions.
3.4. Lessons during the Devon school holidays have to be booked independently of weekly tutoring sessions and in advance, otherwise it is understood that tutoring will not take place during school holidays.
4. FEES AND PAYMENT
4.1. Tutoring is charged at £30 per hour and £40 for 1.5 hours. Lesson prices are fixed and no discounts are given. This includes planning, preparation and worksheet resources. It does not include equipment for your child, exercise books or revision texts.
4.2. Two payment options exist: A weekly payment and monthly billing plan. With the weekly payment, you must pay on the day of tuition. With the monthly payment plan, invoices are sent to you early in the month to cover tuition in the preceding month. For example, tuition received during the month of January will normally be invoiced early in February.
4.3 Please insure that payment for weekly tuition is paid on the day of tuition via BACS. For monthly billing plans, payment must be received within 7 days of the date of the invoice. If you are in arrears, tutoring will be postponed until payment is received.
5. Travel and Expenses
5.1. For lessons at a student’s home, a travel surcharge applies if your home is outside of Tiverton. This will be discussed with you beforehand.
5.2. Please allow 15 minutes variation on the appointed time due to changing traffic conditions.
6. Disclaimer
6.1. Julie Castleden specifically disclaims any implied warranties of title, merchant-ability, fitness for a particular purpose and non-infringement to the extent permissible under the Sale of Goods Act 1979 (as amended).
6.2. Julie Castleden assumes no liability or responsibility for any errors or omissions in the website; any losses or damages arising from the use of the website and/or the Services. She reserves the right to deliver the website and the services in her sole and absolute discretion.
6.3. In no event shall Julie Castleden be liable to You for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the website, the Services or these Terms of Service, on any theory of liability, and whether or not advised of the possibility of damage.
6.4. Julie Castleden, does not seek to exclude liability for death or personal injury caused by her negligence, or fraud or fraudulent misrepresentation on her part. If any applicable authority holds any portion of their section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
6.5. You may use or access services, promotions and websites of third parties. In using or accessing third party services, promotions and websites, You agree to be bound by the terms of service of such third parties governing their services, promotions and websites and hereby acknowledge that Julie Castleden shall not be responsible for the provision of services, accuracy of promotions or content of websites belonging or operated by third parties.
6.6. Julie Castleden specifically excludes liability for any loss, harm, distress or damage suffered by You or any third party as a result of inaccurate information appearing on the Website. Using the services of Julie Castleden and her website is no guarantee of a certain result.
6.7. Julie Castleden does not offer any guarantee that a student using her services will reach a particular standard or pass any examination. By using the website and the tutor Julie Castleden, You irrevocably disclaim any claim You may have against Julie Castleden in respect of the quality of tutoring provided by her and/or the content, format, method or other approach to any tutoring session provided by her.
